TERMS & CONDITIONS

These Terms & Conditions govern the use of services provided by Simame Constructions, a division of Spyeye Ghana Limited located in Sunyani. By engaging our services, you agree to comply with and be bound by these terms.

1. Definitions

• Client: The individual or entity engaging Simame Constructions for services.
• Company: Simame Constructions, a division of Spyeye Ghana Limited.
• Services: All construction, renovation, and related services provided by the Company.

2. Scope of Work

The scope of work for each project will be defined in the contract agreement between the Client and the Company. Any changes to the scope of work must be agreed upon in writing by both parties.

3. Quotation and Payment

• Quotation: The Company will provide a detailed quotation for the project. This quotation is valid for 30 days from the date of issue.
• Payment Terms: Payment terms will be outlined in the contract agreement. Generally, a deposit is required before the commencement of work, with the remaining balance due upon completion or as specified in the payment schedule.
• Late Payments: Late payments may incur additional fees. The Company reserves the right to suspend work if payments are not made as agreed.

4. Project Timeline

The Company will provide an estimated timeline for the completion of the project. While we strive to adhere to this schedule, unforeseen circumstances may cause delays. The Company will communicate any changes to the timeline promptly.

5. Client Responsibilities

The Client agrees to:

• Provide access to the property as needed for the completion of the project.
• Obtain any necessary permissions, permits, or approvals required for the project.
• Ensure that the site is safe and free from hazards.

6. Warranties and Guarantees

• Workmanship: The Company guarantees the quality of workmanship for a period specified in the contract agreement.
• Materials: Any warranties on materials used will be provided by the respective manufacturers.

7. Liability

The Company is insured and will take reasonable steps to protect the property and individuals during the course of the project. However, the Company is not liable for:

• Any damage or loss resulting from circumstances beyond our control, including but not limited to, natural disasters, theft, or vandalism.
• Delays caused by factors outside the Company’s control.

8. Termination

Either party may terminate the contract with written notice under the following conditions:

• If the other party breaches any material term of the contract and fails to remedy the breach within a specified period.
• If the Client fails to make payments as agreed, the Company may suspend or terminate the contract.

9. Dispute Resolution

Any disputes arising from or related to the contract will be resolved through negotiation between the parties. If a resolution cannot be reached, the parties agree to submit the dispute to mediation before pursuing legal action.

10. Amendments

The Company reserves the right to amend these Terms & Conditions at any time. Any amendments will be communicated to the Client and will take effect upon acceptance by the Client.

11. Governing Law

The laws of Ghana govern these Terms & Conditions. Any legal action related to these terms shall be brought in the courts of Ghana.
